Terms of Service

1. Introduction

These Terms of Service govern your use of FansTime and form a legally binding agreement between you and us. By accessing or using FansTime, you agree to be bound by these Terms. If you do not agree, you must not use the platform.

2. Definitions

In these Terms, "FansTime", "we", "us", and "our" refer to the operator of the platform. A "Creator" is a user who uploads and monetizes content or offers paid interactions. A "Fan" is a user who subscribes to, purchases, or otherwise accesses Creator content or paid interactions. "Content" means any material uploaded, posted, transmitted, or made available on the platform, including text, images, videos, audio, livestreams, messages, paid calls, and other materials.

"Fan Credit" means platform credit made available to a Fan for use on FansTime. Fan Credit is not a bank account, e-money account, deposit, stored cash balance, or withdrawable balance. "Creator Earnings" means eligible amounts earned by Creators from completed or otherwise payable transactions, after deduction of platform fees, refunds, chargebacks, taxes, payment processing costs, and any other applicable adjustments.

3. Eligibility

You must be at least 18 years old to use FansTime. By using the platform, you represent and warrant that you are legally permitted to enter into this agreement and to access any content available through FansTime.

If you access, create, offer, upload, purchase, or otherwise interact with adult or explicit content or adult-related features, you further represent and warrant that you have reached the legal age of majority and the legal age required to access, create, offer, and purchase such content or services in your country, state, region, or other applicable jurisdiction.

4. Account Registration

To use certain features of FansTime, you must create an account and provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

We reserve the right to refuse registration, require identity verification, suspend access, or terminate accounts at our sole discretion where necessary for safety, legal compliance, fraud prevention, or enforcement of these Terms.

5. Creator Accounts

To open a Creator account, you may be required to complete identity and age verification, provide payout information, and comply with any onboarding requirements we apply. Creators are solely responsible for the content they upload, the pricing they set, and their compliance with applicable laws, tax rules, and third-party rights.

Creator payout functionality is available only to eligible Creator accounts. Fans are not eligible to request withdrawals or payouts unless they separately qualify and are approved as Creators.

6. Adult Content

FansTime may contain adult or explicit content. By accessing the platform, you acknowledge that you may encounter such material. You are responsible for ensuring that accessing such content is lawful in your location and appropriate in your circumstances.

When applying for Adult verification or accessing Adult features, you must confirm that you are at least 18 years old and have reached the legal age required to access, create, and offer adult content in your country, state, region, or other applicable jurisdiction. You are responsible for complying with all laws that apply to you.

Providing false or misleading information during identity, age, or Adult verification may result in rejection of your verification request, suspension or termination of your account, removal of content, restriction of platform features, and withholding or cancellation of payouts where legally permitted.

7. Content Responsibility

You are legally responsible for all content you upload, post, or otherwise make available on FansTime. You represent and warrant that:

  • you own the content or have all necessary rights, licenses, permissions, and consents;
  • your content does not violate any law or the rights of any third party;
  • your content complies with these Terms and our policies;
  • any person appearing in your content is at least 18 years old and has given valid consent.

We may review, restrict, remove, or disable access to content that violates these Terms, our policies, or applicable law.

8. Subscriptions and Purchases

Fans may subscribe to Creator profiles, purchase pay-per-view content, tip Creators, pay for calls, or engage in other paid interactions available on the platform. By making a purchase, you authorize the applicable payment to be charged using your selected payment method.

Unless otherwise stated, subscriptions automatically renew for the same billing period until cancelled. If you cancel a subscription, access continues until the end of the current billing period, and no further renewal charges will be made for that subscription.

Purchases may also be paid using available Fan Credit where this option is offered by the platform. Fan Credit may only be used for eligible purchases on FansTime and cannot be withdrawn, transferred to another user, exchanged for cash, or paid out to a Fan, except where a refund to the original payment method is required by applicable law, payment network rules, or at FansTime's discretion.

9. Pricing, Fees, and Payouts

Creators are responsible for setting their subscription prices and other monetized offerings. FansTime may deduct platform fees, payment processing fees, chargebacks, refunds, taxes, or other applicable amounts before paying out Creator earnings.

FansTime retains a platform fee, typically 20%, from transactions, except where a full refund is issued or where otherwise determined by FansTime.

Payouts and withdrawals are available only to eligible Creators. Fans do not have a right to withdraw Fan Credit, refund credit, promotional credit, bonus credit, or any other non-earning balance shown in a Fan account.

Creator Earnings become withdrawable only after the relevant transaction has been completed, the platform fee has been deducted, and any applicable refunds, chargebacks, disputes, payment reversals, taxes, processing fees, or adjustments have been resolved or accounted for.

Payouts are only available once minimum payout thresholds and verification requirements are met. Creators are solely responsible for reporting and paying any taxes due on their earnings.

We may delay, reduce, withhold, reverse, or cancel Creator payouts where necessary to account for suspected fraud, abuse, refunds, chargebacks, payment disputes, legal obligations, sanctions screening, identity verification issues, or breach of these Terms.

10. Refunds, Credits, and Chargebacks

Refunds are generally not provided except as explicitly stated in these Terms. Where a refund is granted by FansTime, it will typically be issued as platform credit to the Fan's account, unless otherwise required by applicable law, payment network rules, or determined by FansTime.

Fan Credit is a limited platform credit that may be used only for eligible purchases on FansTime. Fan Credit is not withdrawable, transferable, refundable for cash, or exchangeable for money, except where a refund to the original payment method is required by applicable law, payment network rules, or at FansTime's discretion.

Fans must not submit unjustified refund requests or chargebacks. We reserve the right to suspend or terminate accounts involved in abusive, fraudulent, or bad-faith payment disputes.

Where a refund or chargeback occurs, we may reverse, adjust, or withhold the related Creator earnings. Platform fees may also be retained or adjusted depending on the circumstances of the transaction.

Nothing in these Terms limits any mandatory consumer rights that cannot be waived under applicable law.

10A. Live Call Payments and Refund Rules

FansTime provides real-time paid call functionality between Fans and Creators. Payments for calls are processed in advance and held by the platform until the call outcome is determined.

10A.1 Escrow and Payment Handling

When a Fan pays for a call, the payment is held by FansTime. Creator earnings are only finalized after the call is completed or otherwise resolved under the rules below.

Only Creators may receive payouts from completed or otherwise payable live call transactions. Fans may receive platform credit or a refund where applicable, but Fans are not eligible to withdraw call-related credit or receive Creator-style payouts.

10A.2 Call Timing and Participation Tracking

Call timing, participation, and refund eligibility are determined solely by FansTime's internal call timing and participation tracking system. This system records when a Fan or Creator joins, leaves, reconnects, accepts a call request, and when the paid call duration starts and ends.

For scheduled calls, the Creator must join no later than sixty (60) seconds after the scheduled start time. If the Creator does not make the first join within this grace period, the call may be treated as a Creator no-show.

If the Creator joins a scheduled call after the scheduled start time but within the sixty (60) second grace period, paid call time starts only when both the Fan and the Creator are connected. Paid call time will not be backdated to the scheduled start time unless both participants were already connected at that time.

If both the Fan and the Creator join a scheduled call during the permitted pre-join window, paid call time may begin when the second participant joins, even if this occurs before the scheduled start time.

For instant calls, the Creator is expected to accept the call request within the applicable acceptance window and then join the call within one (1) minute after accepting. Paid time for instant calls starts when the Creator successfully joins the call.

Participation in a call is determined by system-recorded join events. A user is considered to have joined a call when their connection is successfully established within the FansTime system. Temporary disconnections, network interruptions, or user-side technical issues may not pause or extend the paid call duration.

All determinations regarding call timing, participation, completion status, and refund eligibility are based on FansTime's system records.

10A.3 Creator No-Show

For scheduled calls, Creators are given up to sixty (60) seconds from the scheduled start time to make their first join. For instant calls, Creators are given up to one (1) minute from accepting the call request to join. If the Creator fails to join within the applicable time:

  • the Fan receives a full refund, typically as platform credit unless otherwise required by applicable law;
  • the Creator receives no earnings;
  • the platform retains no fee.

A Creator who attempts to make the first scheduled call join after the sixty (60) second grace period may be blocked from joining, and the call may be resolved as a Creator no-show according to FansTime's system records.

10A.4 Instant Call Invitations and Fan Cancellation

After a Fan pays for an instant call invitation, the Fan cannot cancel that invitation for a refund while waiting for the Creator to respond or join. Refund eligibility for instant call invitations depends on the Creator's behavior and FansTime's system records.

A full refund is issued for an instant call invitation if the Creator declines the invitation, does not accept it within the applicable acceptance window, or accepts it but does not join within one (1) minute after accepting.

If the Creator accepts and joins as required, the normal live call rules apply. A Fan who chooses not to participate, leaves early, or changes their mind after payment is not entitled to a refund for that reason alone.

10A.5 Both Parties No-Show

If neither the Fan nor the Creator joins the call, the Fan receives an 80% refund, typically as platform credit unless otherwise required by applicable law. The platform retains 20% of the original payment as a non-refundable platform fee, and the Creator receives no earnings.

10A.6 Fan No-Show

If the Creator joins a scheduled call within the permitted time but the Fan does not join, the call may be treated as a Fan no-show. In such cases, no refund is provided. The Creator receives the applicable earnings and the platform retains its fee, subject to FansTime's internal call outcome and payment handling rules.

For instant calls, if the Creator joins as required but the Fan does not participate or leaves before the paid call begins or continues, FansTime may determine the outcome based on its internal participation records.

10A.7 Completed Calls

A call is considered completed if the full paid duration elapses or the Fan voluntarily ends the call after the paid call has started. In such cases, no refund is provided. The Creator receives the applicable earnings and the platform retains its fee.

Paid call duration starts only according to FansTime's call lifecycle system. For scheduled calls, this generally requires both the Fan and the Creator to be connected, except where these Terms or FansTime's internal systems provide otherwise.

10A.8 Creator Early Termination

If the Creator ends the call early after paid call time has started, the following rules apply. This may result in a reduction of Creator earnings as a penalty for early termination.

  • If the call ends before 50% of the paid duration:
    • the Fan receives a 100% refund, typically as platform credit unless otherwise required by applicable law;
    • the Creator receives no earnings;
    • the platform retains no fee.
  • If the call ends after 50% of the paid duration:
    • the Fan receives a 50% refund, typically as platform credit unless otherwise required by applicable law;
    • 25% of the original payment is paid to the Creator;
    • 25% of the original payment is retained by the platform.

10A.9 Fan Early Termination

If the Fan ends the call early after paid call time has started, no refund is provided. The Creator receives the applicable earnings and the platform retains its fee.

10A.10 Technical Issues

If a call is affected by technical issues, the Fan may submit a support request. Refunds for technical issues are not automatic and will be reviewed on a case-by-case basis. Where granted, refunds are typically issued as platform credit unless otherwise required by applicable law, payment network rules, or determined by FansTime.

User-side network problems, device issues, browser restrictions, blocked permissions, or failure to join from a supported device may affect call participation and may not automatically qualify for a refund.

10A.11 Refund Form and Fan Credit

Unless required otherwise by applicable law or payment network rules, call refunds are issued as platform credit. Such credit may be used for future eligible purchases on FansTime.

Fan Credit is not a bank account, e-money account, deposit, stored cash balance, or withdrawable balance. Fan Credit may not be withdrawn, transferred, sold, exchanged for money, or paid out to a Fan, except where a refund to the original payment method is required by applicable law, payment network rules, or at FansTime's discretion.

10A.12 Platform Discretion

FansTime reserves the right to make the final determination regarding refunds, call outcomes, and payment distribution in all cases, including disputes, abuse prevention, and system integrity. This discretion does not limit any mandatory rights that cannot be waived under applicable law.

11. Acceptable Use

You may not use FansTime in any unlawful, abusive, fraudulent, harmful, or misleading way. You may not upload content that infringes intellectual property rights, violates privacy rights, involves non-consensual material, depicts minors, or otherwise breaches applicable law or our policies.

You may not attempt to misuse Fan Credit, refund systems, chargebacks, payouts, Creator earnings, or withdrawal functionality. You may not attempt to convert Fan Credit into cash or use another account to bypass payout, refund, anti-fraud, or eligibility restrictions.

We may suspend, restrict, or permanently terminate access to FansTime for violations of these Terms.

12. Intellectual Property

You retain ownership of the content you upload, subject to the rights you grant to us under these Terms. By uploading content to FansTime, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, distribute, adapt, and otherwise use your content as necessary to operate, provide, improve, promote, and protect the platform.

Except for user content, all rights in FansTime, including its design, software, branding, and platform materials, belong to us or our licensors.

13. Co-Authored or Third-Party Content

If your content features another person, you must ensure that the individual is at least 18 years old and has provided all legally required consents, permissions, and releases. We may request supporting documentation at any time and may remove content or suspend your account if such documentation is not provided.

14. Platform Rights

We may modify, suspend, restrict, or discontinue any part of FansTime at any time. We may use moderation tools, including automated tools, to detect, review, or remove content that violates these Terms, our policies, or applicable law.

We may also suspend or terminate accounts, withhold payouts, pause transactions, reverse balances, restrict Fan Credit, or remove content where we reasonably believe there has been fraud, misuse, unlawful activity, a payment dispute, or a serious or repeated breach of these Terms.

15. Account Suspension and Termination

We may suspend or terminate your account at any time where necessary to protect the platform, comply with legal obligations, investigate suspected misconduct, or enforce these Terms. You may also delete your account at any time through your account settings, subject to any outstanding subscriptions, payouts, payment disputes, refunds, chargebacks, investigations, or legal obligations.

If a Fan account is closed, unused Fan Credit may be forfeited unless a refund is required by applicable law, payment network rules, or determined by FansTime. If a Creator account is closed, any eligible Creator Earnings may be paid out only after all verification requirements, minimum payout thresholds, refunds, disputes, chargebacks, and legal obligations have been resolved.

16. Disclaimer

FansTime is provided on an "as is" and "as available" basis. We do not guarantee that the platform will always be available, secure, error-free, or compatible with every device or browser. We do not endorse or guarantee the legality, accuracy, quality, or reliability of user-generated content.

17. Limitation of Liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, business, data, goodwill, or opportunity arising out of or related to your use of FansTime.

Nothing in these Terms excludes liability that cannot legally be excluded under applicable law.

18. Indemnification

You agree to indemnify and hold harmless FansTime, its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or related to your content, your use of the platform, or your breach of these Terms or applicable law.

19. Changes to These Terms

We may update these Terms of Service from time to time. Any changes become effective when posted on FansTime. Your continued use of the platform after the updated Terms are posted constitutes your acceptance of those changes.

20. Governing Law

These Terms are governed by the laws applicable to the operator of FansTime, unless mandatory consumer protection laws in your country of residence provide otherwise. Any disputes arising out of or in connection with these Terms shall be subject to the jurisdiction of the competent courts as determined by applicable law.
